General provisions
(1) The provider is David Toth, Jahnstraße 37, 63450 Hanau, Germany, trading under the business name “LWR-Shop” (hereinafter “LWR-Shop”). LWR-Shop offers customers (consumers and entrepreneurs) items for sale – namely auto parts, in particular conversion kits for retrofitting electric headlight levelling systems.
(2) The following provisions apply exclusively to all contracts between LWR-Shop and the customer. The version valid at the time the contract is concluded is decisive. Conflicting terms and conditions of purchase of commercial customers require the express written approval of LWR-Shop to be valid.

§ 2. Conclusion of contract
(1) If a contract is concluded, it is concluded in accordance with the provisions set out in the applicable general terms and conditions.
(2) For orders placed by the customer via the online shop of LWR-Shop (www.LWR-Shop.de), the following applies to the conclusion of the contract:
a) All offers from LWR-Shop are subject to change – i.e. the products and services listed in the online shop do not constitute binding offers; they are rather an invitation to the customer to submit a binding offer to LWR-Shop.
b) By placing the order, the customer submits a binding contractual offer. If LWR-Shop confirms receipt of the order to the customer, this does not constitute acceptance of the order; however, the confirmation of receipt can be combined with the declaration of acceptance.
c) LWR-Shop is entitled to accept the customer’s contractual offer within three working days of receipt. Acceptance can be declared either by express notification or by delivery of the goods. Otherwise the customer is no longer bound by the order.
(3) LWR-Shop reserves the right to deliver an item other than the one purchased if this is reasonable for the customer. This applies, for example, to technical changes or changes in weight that do not affect the functionality of the purchased item, as well as minor changes in shape and color of items for which the design is irrelevant.
(4) The contract is concluded subject to the proviso that LWR-Shop may refrain from performing, or perform only in part, if LWR-Shop is not supplied correctly or properly by its own suppliers. This does not apply if LWR-Shop is responsible for the failure of supply. If the goods or services are unavailable or only partially available, LWR-Shop will inform the customer immediately; in the event of withdrawal, any consideration already paid will be refunded to the customer immediately.

§ 3. CANCELLATION INSTRUCTION
Consumers have a right of withdrawal in relation to the purchased items in accordance with the following instructions:
You can revoke your contract declaration within one month without giving reasons in text form (e.g. letter, fax, email) or by returning the purchased item. The period begins at the earliest on the day after receipt of a cancellation notice to be communicated separately in text form, but not before the day after you receive the goods. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in good time. The revocation must be sent to:

LWR-Shop
Owner: David Toth
Jahnstraße 37
63450 Hanau
Germany
Phone: +49 (0)6181 4906535
Email: info@lwr-shop.de

Consequences of cancellation:
In the event of an effective cancellation, the services received by both sides must be returned and any benefits derived (e.g. interest) surrendered. If you cannot return the received performance in whole or in part, or only in a deteriorated state, you may have to compensate us for the loss in value. This does not apply to the surrender of goods if the deterioration is solely due to their inspection – as would have been possible in a retail store. You can also avoid the obligation to pay compensation by not using the item as an owner and by refraining from anything that affects its value. Items that can be sent as parcels are to be returned at your risk. You bear the cost of returning the goods.

Obligations to reimburse payments must be fulfilled within 14 days. The period begins for you when you send your cancellation or the goods, and for us upon their receipt. We will use the same means of payment for the repayment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

§ 4. Prices, delivery and shipping costs
(1) The prices listed in the offers are final prices without exception – i.e. they include all price components, including any applicable taxes.
(2) Unless otherwise agreed in individual cases, the prices apply without packaging, freight, postage and – if the customer is an entrepreneur – insurance. Additional delivery and shipping costs are therefore incurred when the items are shipped.
(3) If the customer expressly requests (transport) insurance, LWR-Shop is entitled to invoice the customer separately for the resulting additional costs.
(4) The customer assures that he has provided the correct and complete delivery address. If additional shipping costs arise due to incorrect address data – such as repeated shipping costs – the customer must reimburse them if he culpably failed to provide the correct address.

§ 5. Payment methods and conditions
(1) The payment methods listed in connection with the specific offer apply. In addition, payment can be made in cash if the goods are collected by the customer.
(2) The customer must pay all amounts without deduction no later than 10 days after receipt of the invoice; the decisive factor is the receipt of the amount by LWR-Shop. The customer is in default at the latest if he does not pay within 14 days after the due date and receipt of the invoice; for consumers this only applies if this has been specifically pointed out to them in the invoice.
(3) The customer may only offset undisputed or legally established claims.
(4) The customer can only exercise a right of retention if his counterclaim is based on the same contractual relationship.

§ 6. Retention of title
(1) All goods remain our property until they have been paid for in full.
(2) Insofar as the customer is an entrepreneur, he may process and sell the goods delivered under retention of title in the ordinary course of his business, or use them to provide supplies and services. In the event of such sale or use, the customer hereby assigns to LWR-Shop in advance his payment claims against his end customers arising from the resale or from the supplies and services provided; LWR-Shop hereby accepts this assignment.

§ 7. Delivery and shipping conditions
(1) Unless otherwise agreed in individual cases, the items are delivered against prepayment and by shipping. Collection of the item(s) directly from LWR-Shop is possible – after arranging a collection date – against cash payment.
(2) Partial deliveries are only permitted if they are reasonable for the customer or if the customer has expressly agreed. Partial deliveries of a single uniform item of purchase are unreasonable. Partial deliveries have no influence on the customer’s rights in the event of performance disruptions.
(3) For entrepreneurs, the risk of accidental loss and accidental deterioration of the item sold passes upon handover to them or to a person authorized to receive it, and in the case of shipment already upon delivery of the goods to a suitable carrier. For consumers, the risk of accidental loss and accidental deterioration of the item sold always passes upon handover of the goods to the consumer. Default of acceptance by the customer is equivalent to handover with regard to the transfer of risk.
(4) If delivery deadlines are not met due to temporary obstacles to performance caused by force majeure (e.g. war, internal unrest, natural disasters) or similar events (e.g. strike or lockout), the deadlines will be extended by a period corresponding to the duration of the obstacle.

§ 8. Transport damage
(1) The following regulations on transport damage do not restrict the rights of customers, in particular in relation to liability for defects.
(2) Deliveries are to be checked in the presence of the deliverer. In the case of externally recognizable transport damage, the customer is obliged to note this on the shipping documents and have it confirmed by the deliverer; the packaging must be kept.
(3) If the (partial) loss or damage is not externally recognizable, the customer must notify LWR-Shop if possible within 3 days after delivery, but at the latest within 7 days after delivery, so that any claims against the transport company can be asserted in good time.
(4) The customer will support LWR-Shop to the best of his ability insofar as LWR-Shop asserts these claims against the relevant transport company or transport insurer.

§ 9. Liability for defects and guarantee
(1) Inquiries and/or complaints of any kind are to be sent to LWR-Shop using the contact details above.
(2) There is no liability for material defects in the case of damage that occurs after handover of the item due to improper use or handling of the item, i.e. resulting from culpable behavior on the part of the customer or a third party; the same applies to normal wear and tear.
(3) Claims for defects against LWR-Shop are limited to the right to subsequent performance; however, if subsequent performance fails, the customer retains the right to reduce the purchase price or, at his option, to withdraw from the contract.
a) Consumers have the choice as to whether subsequent performance is to take place by rectification or replacement delivery. However, LWR-Shop remains entitled to refuse the type of subsequent performance chosen if it is only possible at disproportionate cost and the other type of subsequent performance remains without significant disadvantages for the consumer.
b) In contrast, LWR-Shop shall initially remedy defects of the purchased item vis-à-vis entrepreneurs at its own discretion by rectification or replacement delivery.
c) The customer is not entitled to remedy a defect in the purchased item himself or to have it remedied by third parties (self-remedy); any expenses incurred for this will not be reimbursed.
d) In the event of replacement delivery, LWR-Shop is entitled to compensation from the customer for use during the period in which the customer was able to use the originally delivered item.
(4) If the goods are used items (e.g. used spare parts), the limitation period for claims for defects is one year from delivery (with the exception of electronic / electrical components), unless the claims for defects are excluded under § 9 (5) of these terms and conditions. This shortened limitation period does not apply insofar as LWR-Shop is liable under § 10 of these terms and conditions or where a third party’s right in rem entitles it to demand surrender of the delivered item.
(5) When selling used goods, the claims and rights of an entrepreneur due to defects – on whatever legal grounds – are excluded; this also applies to defects that arose after conclusion of the contract and before the transfer of risk. The foregoing exclusion does not apply insofar as LWR-Shop is liable under § 10 of these terms and conditions or where a third party’s right in rem entitles it to demand surrender of the delivered item.
(6) Obvious defects must be reported by entrepreneurs in writing within 10 days of receipt of the goods using the contact details above; otherwise the assertion of warranty claims is excluded. To meet the deadline, it is sufficient to send the notice of defects in good time.

§ 10. Liability
(1) LWR-Shop is liable for damage resulting from injury to life, body or health based on a negligent breach of duty by LWR-Shop or an intentional or negligent breach of duty by a legal representative or vicarious agent of LWR-Shop. Furthermore, LWR-Shop is liable for other damage based on an intentional or grossly negligent breach of duty by LWR-Shop or by a legal representative or vicarious agent of LWR-Shop. In addition, LWR-Shop is fully liable for damage covered by mandatory statutory liability, such as under the Product Liability Act, in the case of quality guarantees or in cases of fraudulent intent.
(2) Outside of liability for intent and gross negligence, LWR-Shop is liable for the breach of contractual obligations whose fulfilment is of particular importance for achieving the purpose of the contract (cardinal obligations). In this case, however, liability is limited to the typical, foreseeable damage for this type of contract. Liability for indirect or consequential damage is also excluded unless such damage is foreseeable.
(3) LWR-Shop is not liable to entrepreneurs for the slightly negligent breach of other contractual obligations that are not cardinal obligations. In such cases, liability towards consumers is limited to the typical, foreseeable damage for this type of contract, with no liability for unforeseeable indirect or consequential damage.

§ 11. Return of packaging
(1) In accordance with the packaging regulations, LWR-Shop is obliged to take back product packaging that does not bear the symbol of a comprehensive disposal system (such as the “Green Dot” of Duales System Deutschland AG) and to ensure its reuse or disposal. For further clarification regarding the return of such packaging, the customer can contact LWR-Shop at the above address or telephone number. LWR-Shop will then name a municipal collection point or a waste disposal company in the customer’s vicinity that accepts the packaging free of charge. If this is not possible, the customer can send the packaging to LWR-Shop at the address given above. The packaging will be reused by LWR-Shop or disposed of in accordance with the packaging regulations.

§ 12. Data protection
The protection of personal customer data collected, processed and used in connection with contract processing, service provision and billing is guaranteed within the framework of the statutory provisions. Personal data transmitted by the customer will only be stored and processed – in a manner inaccessible to third parties, insofar as this is technically and organizationally possible; attention is drawn to the insecurity of e-mail – insofar as this is necessary for the execution of the contract, the provision of services and billing. Further personal data are only collected if the customer provides them voluntarily, for example in the context of an inquiry, registration or order. Personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract processing – in particular passing on order data to suppliers or transport companies, or for billing purposes – or if the customer has given prior consent. The customer can revoke his consent at any time with effect for the future. In this case, the personal data will be deleted, as well as when the data are no longer necessary to fulfil the purpose for which they were stored. The customer can request information from LWR-Shop about the data stored at any time.

§ 13. Final provisions
(1) The law of the Federal Republic of Germany applies. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory consumer protection provisions of the law of the state in which the consumer has his habitual residence. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) do not apply.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, or if the customer, being an entrepreneur, has no general place of jurisdiction in Germany, the place of jurisdiction for all disputes arising from or in connection with this contract is Hanau. LWR-Shop is also entitled to sue the customer at the customer’s general place of jurisdiction. Statutory places of jurisdiction for consumers remain unaffected.

Contact
LWR-Shop
Owner: David Toth
Jahnstraße 37
63450 Hanau (Germany)
VAT ID: DE 457549643
Phone: +49 (0)6181 4906535
Email: info@lwr-shop.de

[/vc_column_text][/vc_column][/vc_row]

[mk_page_section bg_image=”https://lwr-shop.de/wp-content/uploads/2018/06/layerslider_startseite_1919x549-1.jpg” bg_position=”center bottom” bg_repeat=”no-repeat” bg_stretch=”true” min_height=”400″ full_width=”true” sidebar=”sidebar-1″][vc_column][/vc_column][/mk_page_section][vc_row css=”.vc_custom_1530534574248{margin-bottom: 40px !important;}”][vc_column][mk_padding_divider][vc_column_text css=”.vc_custom_1792446366987{margin-bottom: 0px !important;}”] Conditions General Terms and Conditions (GTC) with right of withdrawal As is generally known, the warranty for used parts is 12 months (excluding electronic / electrical components)! § 1.
